AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement between you ("you") and 1974 Leather ("we," "us," or "our"), concerning your access to and use of the 1974leather.com website and any related media, channels, or content (collectively, the "Site").
By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must discontinue use immediately.
We reserve the right to make changes to these Terms at any time. Changes will be reflected in the updated "Last Updated" date above. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
The Site is intended for users who are at least 13 years of age. Minors must have parental permission and supervision to use the Site.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and all its content — including text, photographs, graphics, logos, and designs — are our proprietary property and are protected by copyright and trademark laws of the United States.
You are granted a limited license to access and use the Site for personal, non-commercial purposes only. No content may be copied, reproduced, republished, sold, or otherwise exploited without our express prior written permission.
USER REPRESENTATIONS
By using the Site, you represent and warrant that:
- All information you submit is true, accurate, current, and complete
- You have the legal capacity to agree to these Terms
- You are not under the age of 13
- You will not access the Site through automated or non-human means
- You will not use the Site for any illegal or unauthorized purpose
- Your use of the Site will not violate any applicable law or regulation
USER REGISTRATION
You may be required to register with the Site. You agree to keep your password confidential and are responsible for all use of your account. We reserve the right to remove or change a username we deem inappropriate or objectionable.
PRODUCTS
1974 Leather makes every effort to accurately display the colors, features, and details of products on the Site. However, your electronic display may not accurately reflect actual colors and textures — particularly given the natural variation inherent in handmade leather goods.
All products are subject to availability. We reserve the right to discontinue any product at any time. Prices are subject to change.
PURCHASES AND PAYMENT
We accept major credit cards, Apple Pay, and Google Pay. All payments are in U.S. dollars. Sales tax will be added where required by law.
You agree to provide accurate and complete purchase information. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed by resellers or distributors.
RETURN/REFUND POLICY
Please review our Refund Policy posted on the Site prior to making any purchases.
PROHIBITED ACTIVITIES
You may not use the Site for any purpose other than its intended use. Prohibited activities include but are not limited to:
- Systematically retrieving data to build a database or directory without written permission
- Collecting user information for unsolicited communications
- Circumventing security features of the Site
- Impersonating another user or person
- Uploading viruses or malicious code
- Using the Site to compete with us or for unauthorized commercial purposes
- Any use that violates applicable laws or regulations
GUIDELINES FOR REVIEWS
If you post a review on the Site, you agree to:
- Only review products you have firsthand experience with
- Avoid offensive, discriminatory, or false statements
- Not organize campaigns to manipulate reviews
We reserve the right to accept, reject, or remove reviews at our sole discretion.
SOCIAL MEDIA
You may link your Site account to third-party social accounts. By doing so, you grant us access to certain content from those accounts as needed to provide Site functionality. Your relationship with third-party platforms is governed solely by your agreements with those platforms.
SUBMISSIONS
Any feedback, suggestions, or ideas you submit to us become our sole property. We may use them for any lawful purpose without compensation or acknowledgment to you.
THIRD-PARTY WEBSITES AND CONTENT
The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party sites is at your own risk.
SITE MANAGEMENT
We reserve the right to monitor the Site for violations, take legal action against violators, remove content, and otherwise manage the Site to protect our rights and ensure proper functioning.
PRIVACY POLICY
We care about your privacy. Please review our Privacy Policy posted on the Site, which is incorporated into these Terms. By using the Site, you agree to be bound by our Privacy Policy.
DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)
We respect intellectual property rights. If you believe material on the Site infringes your copyright, please notify our Designated Copyright Agent:

Your notification must include: identification of the copyrighted work; identification of the infringing material and its location; your contact information; a statement of good faith belief; and your physical or electronic signature.
If you believe your material was removed in error, you may submit a Counter Notification to the same address including: identification of the removed material; consent to jurisdiction; your contact information; a statement under penalty of perjury that removal was a mistake; and your signature.
TERM AND TERMINATION
These Terms remain in effect while you use the Site. We reserve the right to deny access, terminate accounts, or take legal action for any violation of these Terms without notice or liability.
MODIFICATIONS AND INTERRUPTIONS
We reserve the right to modify or discontinue the Site at any time without notice. We are not liable for any loss resulting from downtime, modifications, or discontinuance of the Site.
DISPUTE RESOLUTION
Informal Negotiations Before initiating arbitration, the parties agree to attempt to resolve any dispute informally for at least 30 days via written notice to the other party.
Binding Arbitration If informal negotiation fails, disputes will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Arbitration will take place in Travis County, Texas. The arbitrator must follow applicable law. Either party may litigate in court solely to compel arbitration or enforce an arbitration award.
Restrictions All arbitration is limited to disputes between the parties individually. No class actions or representative proceedings are permitted.
Exceptions The following are not subject to arbitration: disputes involving intellectual property rights, theft, piracy, invasion of privacy, unauthorized use, or claims for injunctive relief.
Statute of Limitations Any dispute must be commenced within 2 years of the cause of action arising.
CORRECTIONS
We reserve the right to correct any errors, inaccuracies, or omissions on the Site at any time without prior notice.
DISCLAIMER
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY ERRORS, PERSONAL INJURY, UNAUTHORIZED ACCESS, OR DAMAGES ARISING FROM YOUR USE OF THE SITE.
LIMITATIONS OF LIABILITY
IN NO EVENT WILL 1974 LEATHER BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 3 MONTHS PRIOR TO THE CAUSE OF ACTION ARISING.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless 1974 Leather and its owner from any claims, damages, or expenses — including attorney's fees — arising from your use of the Site, your Contributions, or your violation of these Terms.
USER DATA
We maintain data you transmit to the Site for operational purposes. You are solely responsible for your data. We are not liable for any loss or corruption of data.
ELECTRONIC COMMUNICATIONS
By using the Site, you consent to receive electronic communications and agree that electronic agreements and notices satisfy any legal writing requirement.
MISCELLANEOUS
These Terms constitute the entire agreement between you and 1974 Leather regarding the Site. If any provision is found unenforceable, the remaining provisions remain in full effect. These Terms are governed by the laws of the State of Texas.
